for Amended and Restated Texas Eastern Pre-Application
for Term Easement at Liberty State Park

As compensation for the proposed lease and use of temporary work space, the Applicant proposes to tender to the State approximately $2.279 million total compensation, consisting of the following:

1. As rental for the 20-year lease, an annual rent of $33,773.00 per year based upon the rate of $0.83 per square foot per year, which will be escalated at 2.5% for each year after the first year (for an estimated total of $862,721 over the life of the lease);

2. As rental for the use of the temporary work space for a term of one year, a payment of $65,809 based on the same rate of $0.83 per square foot;

3. As mitigation for the permanent ecological, environmental and recreational impact to approximately 0.93 acres of State owned land, additional compensation in the form of the replacement value of the impacted property at a 4:1 ratio in a lump sum payment of $1,350,924.

4. For tree mitigation, a sum to be determined using the guidance found at N.J.A.C. 7:36-26.10.
